Using any of the services provided to you by Blue Axis Hosting binds you to these Terms of Service, and you agree to all provisions contained herein.
All services provided by Blue Axis Hosting may only be used for lawful purposes. Transmission, storage, or presentation of any information, data or material in violation of law is prohibited. This includes, but is not limited to: copyrighted material, material that is threatening or obscene, material that is “adult only” content, or material protected by trade secrets and other statue. Client agrees to indemnify and hold Blue Axis Hosting harmless from any claims resulting from the use of any Blue Axis Hosting service which may damage Client or any other party.
Client agrees not to interfere with the operation of the Blue Axis Hosting system. Client further agrees not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorized access.
Client agrees to abide by any and all future Blue Axis Hosting policy decisions.
"We", "Us", “Blue Axis”, "Blue Axis Hosting", “Servicer”, or "Service": Blue Axis Hosting
"You", "Your", "Client", "Customer": Each person or entity that visits or utilizes any of the Blue Axis Hosting services, including but not limited to any pages accessible through the www.wpzen.host website.
Internet connectivity is a complex system of equipment, services, and third-party hardware and software providers. Blue Axis Hosting offers a 99.9% network uptime guarantee of any and all hardware and software it maintains within its control. Blue Axis Hosting constantly pursues all internal resources as well as any and all third-party or external resources and channels available to maintain maximum uptime. Blue Axis Hosting is not responsible for any down time caused by client's error.
BLUE AXIS HOSTING MAKES NO WARANTIES OR REPRESENTATIONS OF ANY KIND FOR THE SERVICES BEING OFFERED. THE SERVICE IS PROVIDED ON A "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON-INFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. No communication, advice, or information distributed by Blue Axis Hosting or its associates shall create a warranty. Blue Axis Hosting provides no warranty that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free from viruses or other harmful components.
The use of Blue Axis Hosting services is at Client’s sole risk. Blue Axis Hosting is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred to and from the Blue Axis servers and to maintain an appropriate backup of files and data.
Client agrees to comply with the requirements of the Digital Millennium Copyright Act (the "DMCA"), which can be found at http://www.copyright.gov/legislation/pl105-304.pdf and acknowledges that Blue Axis Hosting is a "service provider" under the DMCA and is therefore immune from liability under the DMCA, including 17 U.S.C. § 512.
You agree to indemnify, defend, and hold Blue Axis Hosting harmless from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages Client, Blue Axis Hosting, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to Web site content.
Under no circumstances shall Blue Axis Hosting be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from you or anyone’s use of or inability to use the Blue Axis Hosting services to access your intellectual property, or you or anyone’s reliance on or use of information, services, or merchandise provided on or through the Blue Axis Hosting service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance.
You understand that by writing information onto your public Blue Axis Hosting server account space makes that information available to all Internet users. Client assumes the responsibility and risk of use of the Blue Axis Hosting services. Blue Axis Hosting cannot restrict access and/or theft of Client’s intellectual property once it is made publically available and has no way to protect such information from copyright infringement. If Client’s passwords, private keys, or other private access credentials are lost, shared, or stolen, any and all proprietary information stored within the Blue Axis Hosting services will be at risk of exposure to viruses, bugs, theft, or other.
Pornography and sex-related merchandising are prohibited on any and all Blue Axis Hosting services. This includes sexual content, or direct links to adult content elsewhere. This same prohibition applies to sites that promote any illegal activity or content that may be damaging to Blue Axis Hosting servers or any other server on the Internet. Links to such materials are also prohibited. Blue Axis Hosting will be the sole arbiter as to what constitutes a violation of this provision.
It is your responsibility to ensure that all scripts or programs installed under your account are secure and that permissions of files and directories are set properly. Client is ultimately responsible for all actions taken under their account, including the assignment of “Server Access Keys”, regardless of the delivery method. Client is responsible for generating a secure password for accessing their Dashboard. Periodic password audits may be performed to ensure compliance with this requirement. If a weak password is found after an internal audit, Client will be notified and time will be allowed for the offending password to be corrected before Client’s account is suspended.
All Blue Axis Hosting services, including but not limited to all related equipment, networks and network devices are provided only for authorized Clients. Blue Axis Hosting reserves the right to monitor any and all communications through or with our facilities to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, Client information may be examined, recorded, copied and used internally for authorized purposes. By using the Services, Client consents to monitoring for these purposes.
Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Blue Axis Hosting may, at its discretion, request documentation to prove that Client access to a third party network or system is authorized.
Any account which causes Blue Axis Hosting to receive an abuse report may be terminated and/or have access to services suspended.
Client agrees that client, as the person legally responsible for all use of this account, is at least 18 years of age. If client is under 18 years of age, client must have parental or guardian consent to use any Blue Axis Hosting services and all services must be procured by client’s parent or guardian, in their own name. Client agrees to supply Blue Axis Hosting with a current and truthful name, postal address and telephone number for our records, and client consents to an ongoing obligation to keep this information current. Client also agrees that client is an authorized user of any credit card supplied to Blue Axis Hosting.
All accounts are presently secured by credit card. Client acknowledges that Blue Axis Hosting will collect payment using the card on file prior to providing service.
Client authorizes automatic billing by Blue Axis Hosting on an on-going basis for subsequent terms of service unless the account is cancelled by Client or Blue Axis Hosting prior to the next billing cycle. If Client elects to cancel service, Client must do so prior to the next bill date as exhibited in the Client’s Dashboard to avoid being charged for an additional term of service.
Services provided by Blue Axis Hosting may be cancelled any time prior to the next bill date from within Client’s Dashboard. Blue Axis Hosting does not offer prorated refunds. Once funds have been received on an account, the account will be considered under contract for the services provided under that payment, baring early termination due to Terms of Service violations.
Delinquent accounts are those that remain unpaid on the first day of a new billing term. The Services will be suspended if Client’s account is delinquent for 5 days. Notwithstanding any other rights noted herein, all of Client’s services and electronic media will be deleted if Client’s account is delinquent for 45 days. Accounts continue to accrue charges while they are delinquent or if services are suspended.
Upon notice of violation of the Blue Axis Hosting Terms and Conditions, the account will undergo immediate termination and severed access to any and all open accounts in the possession of the account holder. No backups will be made available. Any pro-rated funds in the possession of Blue Axis Hosting will not be refunded.
If client is found to have spammed, Blue Axis Hosting reserves the right to disable client’s services without warning. In addition, Blue Axis Hosting may impose a $150 penalty for each spam policy violation. Blue Axis Hosting reserves the right to refuse or cancel service to known spammers and reserves the right to determine what violates this policy. As such, any violation may result in cancellation of services without refund.
You may not use Blue Axis Hosting email services, or resources inside the Blue Axis Hosting server network in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages. This extends to the sending of unsolicited mass mailings of any communication that promotes web sites serviced inside the Blue Axis Hosting network, but is sent from an e-mail address not associated with an account inside the Blue Axis Hosting system.
A message is considered unsolicited if it is sent to a recipient who has not expressed opt-in consent to receive such message. This includes but is not limited to any message posted in violation of a newsgroup charter. In an effort to minimize spam emails and protect the service level of all account holders, all email accounts have a 250 email limit per hour.
